7.2
Method of exercising the right: The Buyer exercises the right to withdraw by making an unambiguous statement of withdrawal, which they can send on the Withdrawal Form or by e-mail to the address order@cosmo-paw.com. The statement is considered timely if it is sent to the Merchant before the expiration of the 14-day period.
7.3
Buyer's obligations:
- The Buyer is obliged to return the goods to the Merchant without delay, and no later than 14 days from the date on which they sent the statement of withdrawal (Article 36 of the Consumer Protection Act).
- The Buyer bears the direct costs of returning the goods (return delivery costs).
- The Buyer is solely responsible for the diminished value of the goods that occurs as a result of handling the goods in a manner that is not adequate, i.e. goes beyond what is necessary to establish the nature, characteristics, and functionality of the goods. The goods must be returned unused, undamaged, and in the original box with all labels, without any signs of opening.
7.4
Merchant's obligations:
- The Merchant is obliged to refund all payments received from the Buyer, including delivery costs (except for additional costs if the Buyer explicitly requested a delivery method other than the cheapest standard one), without delay, and no later than 14 days from the date of receipt of the statement of withdrawal (Article 35 of the Consumer Protection Act).
- The Merchant may postpone the refund until they receive the returned goods, or until the Buyer provides proof that they have sent the goods, whichever comes first.
- The refund is made using the same payment method that the Buyer used, unless the Buyer has expressly agreed to another method.
7.5
In the event of a return of goods and a refund to a Buyer who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the return, CosmoPaw is obliged to make the refund exclusively via the VISA, EC/MC, Maestro, Amex and Dina payment methods, which means that, at the seller's request, the bank will refund the funds to the cardholder's account.
7.6
Exceptions to the right of withdrawal: In accordance with Article 38 of the Consumer Protection Act, the Buyer does not have the right to withdraw from the contract in the following cases:

The Merchant is obliged to deliver goods that are in conformity with the contract, which means they meet both the subjective and objective requirements for conformity as defined in Article 53 of the Consumer Protection Act.
8.2
Filing a complaint: The Buyer may file a complaint with the Merchant for non-conformity of goods, incorrectly calculated price, and other defects. A complaint can be filed orally, in writing, or electronically to the contact details specified in Article 2 of these General Terms, along with the receipt or other proof of purchase (Article 63 of the Consumer Protection Act).

- The Merchant is obliged to respond to the Buyer in writing or electronically without delay, and no later than 8 days from the date of receipt of the complaint. - The deadline for resolving the complaint is 15 days from the date of filing.
- In accordance with Article 63, paragraph 10 of the Consumer Protection Act, the deadline for resolving the complaint is paused when the Buyer receives the Merchant's response and resumes when the Merchant receives the Buyer's statement. The Buyer is obliged to respond to the Merchant's response within 3 days of receiving it. If the Buyer does not respond within the prescribed period, it will be considered that they do not agree with the Merchant's proposal.
8.4
Buyer's rights:
- If the non-conformity appears within 30 days of delivery, the Buyer has the right to choose between replacement, an appropriate price reduction, or to declare the termination of the contract (Article 56, paragraph 7 of the Consumer Protection Act 35/2026).
- After the 30-day period, if the complaint is justified, the Buyer has the right to first request the elimination of the non-conformity by repair or replacement.
- If eliminating the non-conformity is not possible or represents a disproportionate burden for the Merchant, or if the Merchant does not eliminate the non-conformity within a reasonable time, or if the non-conformity reappears after the first repair, the Buyer has the right to request an appropriate price reduction or termination of the contract (Articles 56 and 57 of the Consumer Protection Act 35/2026).
